CHANDIGARH: Resentment is brewing amongst the general and other backward class employees against the state government's move to implement 85th. amendment and not constituting the commission for general categories as committed at the time of the last elections said V K Gupta a spokesperson of the General Category Welfare Federation.
The executive committee meeting of the federation was held today and presided over by Shyam Lal Sharma chief organizer. The other main members who spoke are Kuldeep Singh Ratol PSEB, unit President, Gurdeep Singh Tiwana, Kuldeep Singh, and Gurmit Singh Bagri.
The executive urged the chief minister that the 85th. amendment should not be implemented in the state without complying with the certain conditions laid down by the supreme court in M Nagraj case such as to exclude the creamy layer of scheduled caste employees from the benefit of the promotion and no reservation in promotion as well as consequential seniority upon promotion can be allowed where there is no inadequacy of representation in of SCs in services.
Kuldeep Singh Ratol PSEB unit president said that the Federation is not against reservation in direct recruitment if its benefits are extended to the poor deserving persons, but the benefits should not be extended to promotion cases especially to the creamy layer.
The federation urges the Punjab Government not to violate the judgment of the Supreme Court in the case of M Nagraj which clearly held that no reservation in promotion, as well as consequential seniority upon promotion, can be allowed where there is no inadequacy of representation in of SCs in services.
Shyam Lal Sharma state organiser said that as per data collected by the state government in 2018
the percentage of SCs in the against total filled up posts in group A is 22.34% against the prescribed quota of 14%.Similarly in group B, it is 19.99% against 14% , and in group c it is 24.34% against the share of 20 %. These figures clearly show that the representation of SC's in government services is more than the prescribed quota hence there is no inadequacy and no reservation in the promotion can be allowed at all.
V K Gupta said that now fresh data has been collected for the year 2021 and it is understood that it is in excess of their prescribed percentage. The data collected by the government should be published for the information of all to know the real position of adequacy
The state government was requested to establish a state commission as there are so many commissions for the welfare of certain categories and castes. This is required so that the general category can place their grievances before such state commission.
