Punjab Congress lodged complaint to SSP Sangrur for registration of murder case against Haryana HM and SP Jind

CHANDIGRH: Punjab Pradesh Congress Committee president Amarinder Singh Raja Warring today made a written compliant to SSP Patiala to register a murder case against Haryana Home Minister Anil Viz and SP Ambala Jashandeep Singh Randhawa and other accused for brutal murder of young boy Shubhkaran Singh and causing injuring to other protesting farmers.

Raja Warring in his complaint said that farmers unions from the farmers from Punjab have resolved to address their concerns over fixed MSP for crops and other integral issues related to agriculture in the State and for the said purpose the farmers have decided to march towards the Capital New Delhi with the agenda of representing the concerns of the farmers.

He wrote that to the utter despair, the State of Haryana under the headship of the ruling government has laid barricading and fencing all throughout the free national highway with the oblique objective of forcibly curtailing the democratic values of the country which primarily propagate free speech and expression and empower the citizens to raise concerns against undemocratic acts. Apart from these illegal barricading, the State Police under the control of Superintendent of Police Jind and under the direct headship of Home Minister Sh. Anil Vij. The Haryana police have been continuously attacking the protestors by using tear gas cannons, short range weapons etc.

He stated in the complaint that in one such brutal firring, the officials of Haryana Police under SP Jind have shot Late Shubhkaran Singh at the back of his head and the exit wound is prominent on the frontal aspect of skull (Forehead). The Young son of Punjab has died due to the deliberate and intentional firring purposely done by Haryana Police under the direct and specific instructions of Superintendent of Police Jind, Home Minister Haryana and SHO Concerned.

The complaint read that the aforementioned act is not just unconstitutional and non-democratic but is sheerly illegal and punishable by law. The murder of late Sh. Shubhkaran Singh and the ensuing acts of causing injuries to multiple protestors by Haryana Police and further causing damage to property are punishable u/s 302, 307, 326, 335, 338, 341, 435, 148, 506, 120-B IPC & Section 27 of Arms Act. The offences have been committed within the state of Punjab in the area which falls under the jurisdiction of Senior Superintendent of Police Sangrur and thus the present case/FIR can be registered in District Sangrur.

In such circumstances, the decision of Hon’ble Supreme Court of India in Lalita Kumari V. State of Uttar Pradesh AIR 2012 SC 1515 empowers you to immediately register a Case/FIR upon receiving information of commission of cognizable offences. The judgement further elaborates that Even if the place of occurrence is disputed, yet the FIR can be registered and investigation can be carried out. Thus your office is legally empowered to act upon this emergent situation, warring wrote to SSP Patiala.
